PREAMBLE
The present general sales conditions govern sales of products presented on the site of:

Any order presupposes acceptance of the present general sales conditions, of the GOLDAVENUE Terms of Use and of the GOLDAVENUE Privacy Policy, those two documents constituting an integral part of these presents. The sales contract is subject to Swiss legislation.

The consumer acknowledges that he or she is perfectly aware of the fact that his or her approval of the content of the present general conditions does not require any handwritten signature, as the click serves as one. It is therefore up to the consumer wishing to do so to save or print out the present general conditions, it being specified that he or she alone is responsible for the saving and the printout.

1. The Offering
Our product offerings are valid within the limits of available stock.

The articles sold are described and presented with the greatest possible accuracy. If mistakes occur despite our precautions, we may not be held liable in any case in this connection.

The photographs representing the products are only indicative in view of the changes that may occur when entering them on the site.

Due to our suppliers, we may be led to deliver an article to you which is a slightly different product to the one described, but in any case of the same or higher quality as the article ordered, it being specified that practices in the business allow a weight variation of ± 5% by comparison with the indicated weight. Needless to say, in such a case you will benefit from our "satisfaction guarantee", consisting of a right of exchange or reimbursement within a period of 7 (seven) days (cf. article 6).

2. Price
Our prices are indicated in the currency of the country of site consultation, namely: in Euro including all taxes for the European Union, in Swiss Francs including all taxes for Switzerland, in US Dollars excluding taxes for the United States and the other countries (the VAT being function of the applicable rules and regulations in the country to which the merchandise is delivered, the customer being responsible for payment), etc... They are guaranteed as of the order confirmation date subject to typographical or printing errors.

Any change of VAT rate may be passed on immediately in our prices. Those prices are to be understood as excluding any fixed participation in the shipping and packaging expenses pursuant to the amount displayed at the time of order confirmation.

3. Ordering and GOLDAVENUE's Order Confirmation
All orders are placed on line.

The contract is formed as of the time of GOLDAVENUE's issue of an order confirmation.

GOLDAVENUE will confirm your order by e-mail.

You may also print out your order.

4. Payment
Since orders are placed on line, payments are also on line, GOLDAVENUE having a secure payment site. The consumer warrants GOLDAVENUE that he or she holds the required authorizations for using the payment procedure chosen at the time of order validation.

All of our parcels are accompanied by an invoice. In case of a payment incident (rejection, insufficient funds, or other such incident), the service charges and additional proceedings expenses will be for your account.

The delivered articles remain GOLDAVENUE's property until complete payment is made.
Kindly note that for security reasons GOLDAVENUE will require customers to go through the authentication processes as established by major credit card issuers. GOLDAVENUE reserves the right to cancel all credit card transactions for which it cannot satisfy itself the absence of fraud risk.

5. Delivery
The order will be carried out within the period indicated in the order confirmation.

The available articles are delivered to the address by a duly authorized shipping company with fixed participation in the shipping and packaging expenses. Jewels are delivered either to the customer's home or to the address of a third party (except for places that are inaccessible to delivery staff, in which case the customer is informed of that fact at the time of confirmation of the order by a refusal notification).

In the event of unavailability of the ordered product, particularly because of our suppliers, the customer will be informed of that fact by e-mail as soon as possible and will be able to cancel the order. The customer will have the choice between a refund and an exchange of products.

6. Return right or Complaints concerning delivery

6.1. Return right
Ordered jewels may be returned to us within a period of 7 (seven) business days starting with the time of receipt, as long as they have not been worn. A return slip is included in each parcel. We remind you that if you want to return a product, you must first contact the following address by e-mail: customercare@GOLDAVENUE.com, which will inform you about the procedure to be followed.

In case of a return, the credit card used for the purchase will be recredited for the amount of the order, less shipping expenses. The customer must use the same shipping company as the one that delivered the items to him or her in order to comply with the same shipping, customs and insurance conditions.

Failing this, the customer will have to bear all of the consequences.

6.2. Complaints concerning delivery
In the light of the valuable nature of the items sold, the customer will have to inform GOLDAVENUE on the same day as delivery, or at the latest on the first business day following delivery, about any complaint concerning a delivery error and/or non-conformity of the products in terms of type or quality in comparison with the product description appearing in the order confirmation.

The complaint should preferably be filed by e-mail sent to the following address: customercare@GOLDAVENUE.com.

Failing this, the complaint may be made by faxing it to number +41 22 810 1387. Any product to be exchanged or for which a refund is to be made must be returned to GOLDAVENUE in its original packaging under the conditions laid down in article 6.1, sent to the address indicated in the return slip present in the parcel, or failing this to:

7. Personal information
We need to collect personal information about you to take your request into account. By giving us your e-mail address, you will receive confirmation of your order as well as information about our promotions and events via the Internet.

In accordance with federal law (of Switzerland) concerning data protection of 19 June 1992, you have a right to access, modification, correction and deletion of personal information concerning you. If you want to exercise that right, you only have to write us to that effect (GOLDAVENUE, 10 Promenade St Antoine 1204 GENEVA ? SWITZERLAND) giving us your last name, first name and address, or you may make the request, inter alia, via our e-mail address customercare@GOLDAVENUE.com.

Through us, you may receive proposals from other companies or entities, or may also be informed of our offerings by e-mail, telephone or mail. If you want to exercise a right to protest against recording information concerning you or the transfer of such information, you may either write us or make such a request "on line", via our e-mail address customercare@GOLDAVENUE.com, informing us of your last name, first name and address.

GOLDAVENUE reserves the right to collect information concerning the user, particularly by using cookies. You are invited to familiarize yourself with the GOLDAVENUE Terms of Use and with the GOLDAVENUE Privacy Policy, those two documents constituting an integral part of the present contract.

8. Intellectual Property
All elements of the GOLDAVENUE website, whether visual or sound, including the underlying technology are protected by copyright, trademarks or patents. They are GOLDAVENUE's sole property.

A user who has a personal Internet website available may install a simple link on his website referring directly to the GOLDAVENUE website home page. Such a case will not be considered as an implicit affiliation agreement. On the other hand, any hypertext link referring to the GOLDAVENUE website and using the framing or in-line linking technique is formally prohibited.

In any case, any link, even if tacitly authorized, must be removed in response to a simple request by GOLDAVENUE.

9. Liability
GOLDAVENUE may not be held liable in connection with any drawbacks or damage resulting from use of the Internet network, such as in particular an interruption of service, the presence of computer viruses or external intrusion, or more generally for any case characterized by the courts as events of force majeure.

10. Partial invalidation
If one or several provisions of the present General Sales Conditions is or are ruled to be invalid or void in application of a law, a regulation or a decision that has become final, the other provisions shall remain valid and shall retain all of their force and scope.

11. Evidence
The data contained in GOLDAVENUE's computer systems shall be considered as evidence of communication, orders and payments occurring between GOLDAVENUE and the customer.

12. Dispute settlement
In case of a dispute, the parties shall seek an agreed solution before any judicial proceedings. Failing this, any judicial action shall be taken to the competent courts of the district of GOLDAVENUE's registered office.
